Evio Pharmacy Solutions, LLC (“Evio,” “we,” “our,” or “us”)is committed to protecting your personal information.  This Privacy Policy(“Privacy Policy”) describes the types of personal information we collect through Evio’s websites and any other Evio sites that link to this Privacy Policy (collectively, the “Sites”), how we use and disclose that information, and the choices you may have regarding your personal information.  

Evio may change this Privacy Policy from time to time, and the revised version will be posted to the site. We encourage you to regularly review this Privacy Policy.

1. Collection and processing of personal information

Evio collects and processes personal information for Evio’s internal business purposes, for Site-related purposes, and as otherwise described in this Privacy Policy.

“Personal information” is information that is linked or reasonably linkable to an identified or identifiable individual.

Evio may collect personal information from the following sources: directly from you, automatically (such as through cookies or similar technologies on the website), and, in some cases, from third parties.

Personal information you provide to us

Communications.If you submit your name, email address, organization name, or other information through the Sites, we may use this information to respond to your inquiries or communications.

Job applicants. Evio utilizes a third-party platform, Greenhouse, to publish open job postings, and to collect job applications from potential candidates.Information you provide through Greenhouse is subject to Greenhouse’s privacy policy, which can be found at: https://www.greenhouse.com/privacy-policy. Additional information regarding how we use and disclose personal information you provide when applying for a job is provided below under “JOB APPLICANT INFORMATION.”

Social media. If you post or engage with content on social media pages operated by Evio, we may receive personal identifiers (e.g., username) or characteristics you have made public. The third-party operators of social media sites also receive such information, and their use of your personal information is governed by their own terms of use and privacy policies.

Information collected automatically (including via cookies)

Like many companies and websites, Evio uses cookies and other tracking technologies (collectively, “Cookies”). Cookies are small files of information that are stored by your web browser software on your computer hard drive, mobile device, or other devices (e.g., smartphones or tablets).

Using Cookies, we automatically collect certain personal information through your use of our Sites, such as the following:

  • Usage Information (Site pages accessed or viewed, links clicked, browsing frequency
  • Device Information (browser type, operating system, device model, IP address).
  • Mobile Device Information (aggregate information about device type and carrier)

Google Analytics
Evio uses Google Analytics, a web analytics service from Google. Google Analytics uses cookies to help us understand how visitors interact with our Sites, generate activity reports, and provide services related to Site usage and traffic. It may collect personal identifiers (such as IP addresses), internet or network activity information, device information (including browser type, device ID, and operating system version), and details about how you navigate Evio’s websites (such as the link that brought you to a page). This information is transmitted to and stored byGoogle and is governed by Google’s privacy policies. Cloudflare
Evio uses Cloudflare, a content delivery network and security service provider, to help protect the Site, improve performance, and prevent fraudulent or malicious activity. Cloudflare may process technical information such as IP addresses, request metadata, and security-related data and may place strictly necessary cookies to enable these functions. Cloudflare processes such information on Evio’s behalf in accordance with Couldflare’s privacy policy.

Information we collect from other sources

In some cases, we may receive personal information about you from other sources. This includes government entities, advertising networks, data brokers, operating systems and platforms, mailing list providers, social networks and advertising and marketing partners.

Protected Health Information

Evio sometimes acts as a business associate to health plans, or as a subcontractor to the health plan’s business associates. In this role, we may receive or use protected health information (“PHI”) as defined under the Health InsurancePortability and Accountability Act (“HIPAA”). PHI is not considered personal information that is subject to this Privacy Policy.

For questions regarding the handling, use, or disclosure of PHI, please refer to your health plan’s or provider’s Notice of Privacy Practices, as applicable.

2. How we use personal information

In addition to the purposes stated above and subject to applicable law we may use the personal information we collect in to:

  • Operate, maintain, and improve our Sites;
  • Protect the security and integrity of our Sites;
  • Respond to your communications and provided requested information;
  • Process job applications and conduct recruitment activities;
  • Detect, investigate, and/or prevent fraud or unlawful activities;
  • Enforce our Terms of Use, this Privacy Policy, and other applicable policies;
  • Protect Evio’s legal rights and the rights of others;
  • Fulfill any other purposes for which information was provided;
  • Carry out any use compatible with the original purpose of collection; and
  • Comply with applicable law and otherwise fulfill our legal obligations.  

3. How we disclose personal information

Evio may disclose personal information for our business purposes described below.

  •  Service providers and vendors.  We may share information, including personal information, with vendors and service providers that support our website operations, analytics efforts, recruitment processes, or other business activities.
  • Legal and regulatory disclosures.  We may disclose information to law enforcement, courts, governmental agencies, attorneys, or other advisors when required or appropriate to comply with legal obligations, legal process, or to protect the rights, property, or safety of Evio, users of the Sites, or others.
  • Merger, sale or other asset transfers.  If Evio undergoes a merger, acquisition, asset sale, financing, reorganization, bankruptcy, or similar corporate event, personal information may be shared with relevant parties for purposes related to the transaction.   
  • With your consent. We may disclose your personal information to any third party when you consent or direct us to do so.
  • Other disclosures. We may disclose personal information for any purpose described in this Privacy Policy or when necessary to protect health or safety of others.

4. Job applicant information

When you apply for a job with Evio, you may provide certain information during the application and recruitment process, such as:

  • Your name, address, email address, telephone number, and other contact information.
  • Resume,curriculum vitae, work history, education, transcripts, or similar materials.
  • Interview orphone screening information.
  • Employmentpreferences, salary and benefits expectations, and related details.
  • Voluntarily submitted demographic or sensitive information.
  • Reference information, including information provided by third party references.
  • Information related to any assessment you may take as part of the interview screening process.
  • If you receive a contingent offer of employment:
    • Information received from background checks or drug testing, including information provided by credit reporting agencies or other third parties.
    • Information related to government identification (e.g. social security number, identification cards, etc.) and date of birth.
  • Other information we may reasonably request.

In addition to the purposes described elsewhere in this Privacy Policy, Evio may use the information you provide during the application and recruitment process for the following non-exhaustive list of purposes:

  • Facilitating the application and recruitment process.
  • Communicating with you about the application and recruitment process.
  • Assessing your skills, qualifications, and interests against available job opportunities at Evio.
  • Verifying your information and carrying out reference checks and/or conducting background checks if you are offered a job.
  • Creating and submitting reports required under applicable law.
  • Complying with applicable laws, legal processes, or enforceable governmental requests or orders.
  • Protecting the rights and property of Evio, its applicants, candidates, employees or the public as permitted or required by applicable law.

If you are offered and accept employment with Evio, the information gathered during the application and recruitment process will become a part of your employment record.

When required by applicable law, Evio may seek your consent to process your information or to request information about you from third parties (e.g.educational institutions, credit reporting agencies, drug testing results, etc.).

Evio may use third-party service providers acting on Evio’s behalf to perform some of the services described above, including for the purposes of conducting background checks.  Evio may also be required to disclose your information to governmental agencies or other third parties, such as tax authorities, courts, tribunals, or other law enforcement agencies or in response to legal process. 

Evio may retain your job application materials for purposes such as, but not limited to:

  • Considering you for other current or future roles at Evio
  • Complying with applicable law, including any laws related to the retention of information.
  • Defending itself, its owners, directors, officers, employees and affiliates from legal claims.

5. "Do Not Track" signals

Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Because a uniform standard does not exist for “Do Not Track” signals, the Sites do not currently interpret, respond to or alter their practices when they receive “Do Not Track” signals.

6. International data transfers

If you are located outside the United States—particularly in Switzerland, the United Kingdom, or the European Economic Area—please be aware that Evio is based in the US and processes information within the US as described in this Privacy Policy. By using the Sites, your information, including personal information, will be transferred to us in the US, where privacy and data protection laws may differ from and offer less protection than those in your home country. Your information may also be subject to access requests from US government, courts, or law enforcement authorities under US law.

We do not market to or solicit customers or job applicants outside the US through the Sites, and users should not expect to exercise rights available under the EU General Data Protection Regulation(“GDPR”). By using the Sites, you consent to the transfer of your information to the US and acknowledge that the Sites and our services are not subject to the GDPR or similar international privacy laws, and that the rights granted under those laws do not apply.

7. Security

We maintain commercially reasonable security measures to protect the personal information we collect and store from loss, misuse, destruction, or unauthorized access. However, no security measure or modality of data transmission over the Internet is 100% secure. Although we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.

8. Third party websites

Evio’s website may contain links to third-party websites. Linked websites are not under our control. This Privacy Policy does not apply to the practices of, or personal information collected on, third-party websites. Evio is not responsible for the actions or privacy policies of those who operate or interact with such websites.

9. Children's privacy

This website is not intended for use by children under 18 years of age.

For the avoidance of doubt, Evio does not knowingly collect, maintain or use personal information from children under 18 years of age.

10. California Shine the Light Law

We do not disclose personal information obtained through our Sites to third parties for their direct marketing purposes.Accordingly, we have no obligations under California Civil Code § 1798.83.
